Foreign holdings require Schedule FA disclosure, capital gains reporting, and dividend tax handling. Non-compliance attracts penalties.

Non-US persons with US securities above $60,000 may face US estate tax at rates up to 40%. India has no estate tax treaty with the US.

LRS limit

Indian residents can invest up to $250,000 per financial year (April–March) under RBI's Liberalised Remittance Scheme.

TCS on remittances

No TCS for remittances up to ₹10 lakh in a financial year. TCS applies above this threshold and is claimable as credit when filing ITR.

Capital gains tax

Long-term (held over 24 months): 12.5%. Short-term (under 24 months): taxed as per your income tax slab. Consult your CA for applicability to your specific case.

Dividend tax

25% US withholding tax on dividends. Claimable as foreign tax credit against Indian tax liability. Consult your CA on how to claim this credit in your ITR.

Foreign asset reporting

All foreign securities must be disclosed in Schedule FA of your Income Tax Return. Mandatory annual disclosure under FEMA. Non-disclosure attracts penalties.

US estate tax

Non-US persons holding US securities above $60,000 may face US estate tax at rates up to 40%. India does not have an estate tax treaty with the US. This is a material consideration for larger holdings — consult your CA or cross-border tax professional.

Funding process

From India: LRS via bank (ICICI, Kotak, HDFC online; others via Form A2 + beneficiary details). From abroad: direct wire transfer, no $250K limit.
